These Terms of Service ("Terms") govern your access to and use of the NicheCalc website at nichecalc.polsia.app (the "Site") and all services, tools, calculators, APIs, and features provided through the Site (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. Acceptance of Terms

By accessing or using the Site, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

NicheCalc provides free and paid construction, landscaping, plumbing, electrical, HVAC, roofing, and home improvement calculators. The Services include:

  • Free calculators: Web-based calculation tools accessible without an account.
  • NicheCalc Pro: A paid subscription that provides PDF exports, project saving, and ad-free browsing.
  • Lead generation: Optional "Get a Free Quote" forms that connect you with local contractors.
  • Embeddable widgets: Calculator widgets for third-party websites (free with backlink; white-label available for paid plans).
  • Calculator API: Programmatic access to our calculation engines (usage-based pricing).

3. Calculator Results — No Warranty of Accuracy

This is critical: All calculator results are estimates intended for planning and reference purposes only. NicheCalc calculators are not a substitute for professional engineering, architectural, or trade expertise.

  • Material quantities are estimates that may vary based on actual site conditions, material waste, supplier packaging, and installation methods.
  • Cost estimates are approximate and based on national averages. Actual prices vary significantly by region, supplier, and market conditions.
  • Building codes, load requirements, and safety standards vary by jurisdiction. Always consult qualified professionals and local building authorities before beginning any construction project.
  • You assume full responsibility for verifying calculations before purchasing materials or beginning work.

4. User Accounts and Pro Subscriptions

4.1 Account Creation

Some features require creating an account. You agree to provide accurate information, keep your login credentials secure, and notify us immediately of unauthorized access to your account.

4.2 NicheCalc Pro

NicheCalc Pro is a paid monthly subscription. By subscribing, you agree to:

  • Pay the applicable subscription fee (currently $9.99/month) via our payment processor, Stripe.
  • Your subscription will automatically renew each month unless cancelled before the renewal date.
  • You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact us if you believe a refund is warranted.

5. Lead Generation Forms

When you submit a lead form ("Get a Free Quote"):

  • Your contact information and project details will be shared with one or more contractors or service providers in your area.
  • NicheCalc does not guarantee the quality, reliability, or pricing of any contractor. We are a referral service, not a contractor.
  • You may receive communications from referred contractors via email or phone based on the information you provided.
  • You are not obligated to hire any contractor referred through the Service.

6. Embeddable Widgets and API

6.1 Free Embed

You may embed NicheCalc calculators on your website for free, provided you retain the "Powered by NicheCalc" attribution link. Removal of attribution requires a paid plan.

6.2 API Usage

API access is subject to usage limits and rate limiting based on your plan. You agree not to:

  • Exceed your plan's rate limits or use automated means to circumvent limits.
  • Resell API access without authorization.
  • Use the API for any illegal or unauthorized purpose.

7. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
  • Scrape, copy, or reproduce the Site's content, calculators, or formulas without permission.
  • Attempt to gain unauthorized access to the Site, its servers, or any related systems.
  • Interfere with or disrupt the Site or its infrastructure.
  • Submit false or misleading information through any form on the Site.
  • Use automated bots, scrapers, or crawlers to access the Site beyond standard search engine indexing.

8. Intellectual Property

All content on the Site — including text, graphics, logos, calculator designs, formulas, code, and software — is the property of NicheCalc or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Third-Party Links and Services

The Site may contain links to third-party websites, including material suppliers (Home Depot, Lowe's, Amazon), advertisers, and contractor services. These links are provided for convenience only. NicheCalc does not endorse, control, or assume responsibility for the content, products, or services of any third-party site.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICHECALC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, MATERIALS, OR PROPERTY RESULTING FROM RELIANCE ON CALCULATOR RESULTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless NicheCalc and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes take effect when posted to the Site. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. Sections 3, 8, 10, 11, 12, and 13 survive termination.
